Background

Vernon has for over 20 years provided expert specialist advice to individuals and businesses encountering issues arising from financial distress. He is equally adept at acting for investors and creditors seeking return from financially distressed businesses, as he is acting for individuals and company boards considering refinance, restructuring or business rescue options.

Acting with discretion and sensitivity he also provides advice and assistance to those who are entering into schemes which involve family wealth protection, guiding clients through the minefield of legislation and regulation that can wreck such schemes.

Vernon is head of the firms Business Recovery and Reconstruction offering and is a Fellow of the Association of Business Recovery Professionals. A prolific author, commentator and lecturer, he has written seven books on insolvency law and practice each published by the Law Society.

  • Acting for a serial investor/business angel in a situation of potential business failure and loss of an investment. Securing the initial investment and providing advice throughout the business reconstruction of the company. Further funding ensured the eventual rescue of the business, now fully controlled by the investor
  • Advising world renowned individual in providing further funding to his son-in-laws insolvent business and advice to his daughter regarding gifts and the protection of family monies in the event of her husband’s bankruptcy

  • Acting for the beneficiaries of a family trust being attacked by the trustee in bankruptcy of the eldest sibling
  • Negotiation and mediation of a dispute regarding the high value estate of a formerly wealthy individual. The settlement ensured that the families’ interest were protected through the continued use of various trust structures
  • Acting in proceedings involving a former wife seeking to enforce a significant money judgment obtained in divorce proceedings against her wealthy ex-husband now based abroad. This has involved freezing injunctions, international proceedings and the appointment of a Court appointed Receiver
